Mobile Website Design TERMS & CONDITIONS

 


 

The Company Name used on the Mobile Website Design Service Order Form is herein referred to as "Client" and Deborah McGeorge: Project Assistant On-The-Go is herein referred to as "Developer".

Rates: Basic Mobile Website Package = $99 … handled electronically. Requesting Developer to pick up materials or payment or for any in-person consultations will incur an extra charge. Rates for additional services not listed in the package description on page 1 of this Order Form will vary based on type of project and will be agreed upon in writing prior to any work being done.

• Developer will create and install a customizable and updatable "Free" mobile website on the Octomobi hosting platform. Currently, Octomobi does not charge any fees for their "Free" mobile website plan. If at any time in the future they change their policy and begin charging fees, such fees will be the responsibility of the Client. (Some upgrades are only possible by switching to the “Pro” plan for $59 per year. See upgrades list.) Client agrees to comply with Octomobi’s Terms of Service atwww.octomobi.com/terms.phpUse of the service is subject to this Agreement in its entirety.One revision of the website is included in the Rate prior to the final approval. Further revisions will be billed at the maintenance rate shown below.

" Pro" plan upgrade:  If Client prefers the “Pro” plan rather than the “Free” plan, the recurring cost is $59 per year. Developer will collect this charge from the Client annually near the anniversary date on the account.

For restaurant menus or service list upgrade pak: Developer will install a customizable and updatable mobile menu on either the Locu or AllMenus hosting platform. Currently, these companies do not charge any fees for their products. If at any time in the future either of or both companies change their policy and begin charging fees, such fees will be the responsibility of the Client. Client agrees to comply with either Locu’s Terms of Service atlocu.com/legal/termsofserviceor AllMenu’s Terms of Use atwww.allmenus.com/terms-conditions. Use of these services is subject to these Agreements in their entirety. One revision of the menu is included in the Rate prior to the final approval.

Website content: Developer will use some text content from Client’s existing desktop website and/or Facebook Business Page. Since the mobileaudience is on-the-go and generally unwilling to scroll through paragraphs of text on small Smartphone screens, this Agreement is for standard pages with amaximum of 350 words or 2,000 characters & spaces. Light text editing is included. Writing services are available for an additional fee. If Client does not have a desktop website, text must be emailed to Developer in a timely fashion.

Maintenance: Updates and moderate changes to Client’s website and/or menu after its completion will be provided at the maintenance rate of $35 per hour on an “as needed” basis, including correspondence, consultations, and travel time (if any). Billing will be for a minimum of one hour, additional time is billed in 15-minute increments. Examples of updates include making minor graphic or color changes, adding/deleting/editing text, changing contact information, etc. If Client wishes to personally make edits instead of hiring Developer to do so, an upgrade to the $59 per year “Pro” Plan will be necessary, plus a one-time $25 fee for Developer to create customized written instructions and supply login information.

Graphics: Client will supply high resolution images which are not in violation of any copyrights to be used as a logo and for the optional photo gallery. Heavy editing will incur an additional fee. If Client does not have a logo, or supplies images which are not of high enough quality, Developer will create a basic image header for the home page. Custom logo design is available for an additional fee. (See upgrades list.)

Estimated Time Frame: 4-5 business days from the time Developer receives Client's payment and materials. Longer if custom quote work is ordered.

Sales Tax for Florida clients: Final products transmitted electronically are not subject to Florida state sales tax. Any tangible, physical products will be charged 6% sales tax.

Payment Terms: Payment for the Basic Package and any upgrades with set pricing is due with this Order Form submission. Fees for any custom quote work will be approved by client in advance and billed at the end of the project, along with any other balances. Final invoice charges will be due within no later than 3 business days of invoice.

Payment Options: PayPal, Visa, MasterCard, Discover, American Express, checks from St. Augustine Florida banks, or cash.

Design byline for Deborah McGeorge: Project Assistant On-The-Go will appear in the bottom area of the home page, and must not be removed.

Relationship of Parties: Developer is an Independent Contractor and is not an employee of Client.

Confidentiality: All Confidential Information which may be obtained from any source as a result of this Agreement shall be regarded and preserved as confidential. Each party agrees not to directly or indirectly use any proprietary information for its own benefit nor to divulge, disclose, or communicate such information to any third party without prior written consent.

Referral Bonus Program: If Client refers a new customer to Developer, Client will receive a one-time bonus discount of 15% off any products or services offered on www.insidersecrets.info after each new customer’s first payment is received.


All services are provided solely on a best-efforts basis. By signing below, Authorized Representative of Client confirms an understanding of and agreement to all terms and conditions contained in this entire three-page document.
